Order of the National Green Tribunal in the matter of Dr. Amit Kumar Vs State of Uttar Pradesh & Others dated 28/05/2025.

The applicant has raised a grievance against setting up of a tyre pyrolysis plant by M/s Adideva Carbon LLP. According to the applicant, the tyre pyrolysis plant has been set up at village Sakauti, district Shamli, Uttar Pradesh. Applicant submits that siting criteria as provided in the standard operating procedure (SOP) for recycling of waste tyre scrap for the recovery of tyre pyrolysis oil, pyro gas and char in tyre pyrolysis oil (TPO) units issued by Central Pollution Control Board (CPCB) has been violated.

The applicant said that constructing the tyre pyrolysis plant with a capacity of 230 metric tonnes per day at a location that is very close to ecologically and socially sensitive areas including the Khokhari river (within 40 meters), near Irrigation Department drain (0 meter), Mata Ka Mandir (50 meters), a government inter-college (100 meters), and residential areas of two villages (within 300–400 meters). Further, the site is directly adjacent to a highway.

Counsel for the applicant submitted that consent to establish (CTE) application was made by the industry on September 19, 2024, therefore, guidelines which have been issued by the CPCB on January 16, 2024 apply to the unit. However, the Uttar Pradesh Pollution Control Board (UPPCB) without considering the issue of siting criteria issued consent to establish (CTE) dated October 21, 2024.

The NGT, May 28, 2025 directed notice to be issued to tbe respondents for filing their response. Divisional Forest Officer (DFO), Shamli; Groundwater Department, Uttar Pradesh; M/s Adideva Carbon LP; State of Uttar Pradesh; Central Pollution Control Board; Uttar Pradesh Pollution Control Board; Muzaffarnagar UPPCB regional office and District Magistrate Shamli have been directed to file their response.
