Action taken report by the state of Rajasthan in the matter of Omprakash Somani Vs State of Rajasthan & Others dated 05/02/2025.
The report was in compliance with the NGT order, January 13, 2025 (central zonal bench, Bhopal).
The court was informed that the state authorities, police and the Panchayati Raj department undertook multiple operations to remove illegal encroachments on Dharma talab, Raila, and adjacent areas between October 2023 and January 2025.
Encroachment removal activities were carried out in multiple phases. For instance, on October 3, 2023, illegal encroachment on Dharma talab, Raila was removed by the state team with the help of police and Panchayati Raj department. On January 4, 2025, further encroachments including 13 concrete structures which included multi-storey residential houses, a madrasa, petrol pump, school and shops were marked for removal. Likewise, encroachments/constructions, including a private school, madrasa, and e-Mitra shops with attached lavatory facilities constructed for commercial purposes, were demolished at the site of the Abadi Patta of Nirmala Devi Jinagar.
Out of the total encroached area of 0.8638 hectares, encroachment has been successfully cleared from 0.4438 hectares. The remaining 0.42 hectares (comprising 0.3162 hectares of commercial land and 0.1038 hectares occupied by nine residential houses) remains subject to the stay order passed by the High Court, Jodhpur bench.
