Order of the National Green Tribunal in the matter of Mahavir Singh Vs Govt. of N.C.T. of Delhi & Others dated 24/12/2024.

In the application, the applicant being a resident of village Neelwal, Tikri Kalan, Delhi has raised a grievance against the illegal dumping and burning of plastic waste in violation of the Plastic Waste Management Rules, 2016. The applicant has also raised a grievance in respect of non-compliance of various provisions of the Air (Prevention and Control of Pollution) Act, 1981 and Water (Prevention and Control of Pollution) Act, 1974.

Counsel for the applicant referring to the facts disclosed in the submissions filed on December 17, 2024 has submitted that illegal burning and dumping of plastic and electronic waste is taking place at some locations (Nerula Raod, Ranohola Extension; Jharoda Kalan; Bakkarwala Road, Mundka and Tikri Kalan).

Counsel for the applicant has referred to the photographs filed and has submitted that the illegal burning of plastic and e-waste is causing enormous air pollution. The court was also informed that despite various complaints to the authorities, no action has been taken till now.

The court was also informed that earlier also the applicant had filed the application and an order was passed but there was no improvement at the ground level. The NGT, December 24,2024 directed notice to be issued to the authorities. Respondents are directed to file their response/reply by way of affidavit at least one week before the next date of hearing, April 21, 2025, the order said.
