Order of the National Green Tribunal regarding dumping of waste near the banks of river Baya, Vaishali, Bihar, 26/11/2024
Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Narendra Singh Vs State of Bihar dated 26/11/2024.
A letter petition was filed by Narendra Singh alleging that in his Rampur, district Vaishali, Bihar, the Mukhiya Sanjeet Kumar Paswan of Lashmipur Brahmbatta Panchayat is constructing the panchayat bhawan and garbage is being dumped near the banks of river Baya. As a result of dumping of construction materials on land near the banks of river Baya, the entire area is getting polluted and in case there is a flood, it would result in loss of life and material. Further, any such construction is not permissible within 100-200 meters of a river / waterbody.
The court directed notice to be issued to the District Collector, Vaishali, Bihar; Department of Environment, Bihar; Bihar State Pollution Control Board; Mukhiya Sanjeet Kumar Paswan. All the respondents have been directed to file their reply.
The tribunal also directed a two member committee to visit the site in question and submit its report within four weeks with respect to the allegations made. In case any violations are found, appropriate remedial action should be taken, the order said.
