Order of the National Green Tribunal regarding construction of a fuel depot by BPCL in Majitha, Pakyong district, Sikkim, 18/04/2024
Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Yodh BDR Thapa Vs Bharat Petroleum Corporation Limited & Others dated 18/04/2024.
The execution application was filed by the applicant seeking compliance of the order of the NGT, April 17, 2023 to prohibit Bharat Petroleum Corporation Limited (BPCL) from proceeding with construction of fuel depot at Plot No.2242 in Majitha, Pakyong District, Sikkim.
A direction has also been sought to the Central Pollution Control Board to prepare a Standard Operating Procedure (SOP) listing out specific criteria including but not limited to, identification of area, size, storage, distance and other scientific measures before establishment of a fuel depot in the country. Direction has also been sought to the Sikkim State Pollution Control Board to prepare a Standard Operating Procedure (SOP) for establishment of fuel depots in Sikkim.
The NGT, April 18 directed notice to be issued to the respondents which included among others Bharat Petroleum Corporation Limited (BPCL), Sikkim State Pollution Control Board. All the respondents have been directed to file their counter-affidavits by the next date of listing, May 24, 2024.
