Order of the National Green Tribunal in the matter Shri Krishan Kashyap Vs State of Uttar Pradesh dated 23/02/2024.

In the original application, the grievance raised is that some antisocial elements have laid the underground pipeline and are discharging sewer waste of Shivam Enclave Colony, Old Haibatpur, Greater Noida in the Hindon river in violation of the environmental norms.

The response on behalf of the Uttar Pradesh Pollution Control Board (UPPCB) has been filed disclosing that the joint committee had carried out the inspection and that "the Shivam Enclave colony, old Haibatpur is situated in flood plan area of Hindon river, which is developed like other unplanned residential areas situated along both sides of Hindon river in Gautam Budh Nagar". Further there is no sewerage network in that area and that sewage generated from the colony is being discharged directly into Hindon river.

The report filed by the District Magistrate, Gautam Budh Nagar also stated that Shivam Enclave Colony, old Haibatpur is situated in flood plain area of Hindon river and it has no sewerage network and sewage generated from it is directly discharged in Hindon river.

The authorities have been granted four weeks time to file the action taken report and the next hearing of the case will be on May 6, 2024.
