Order of the National Green Tribunal regarding dumping of waste in open areas, Bhopal, Madhya Pradesh, 17/10/2023
Order of the National Green Tribunal (Central Zone Bench, Bhopal) in the matter of 'In re: Newspaper article published in Dainik Bhaskar daily dt. 16.10.2023 regarding dumping of waste and house waste in a vacant plot and burning them in open' dated 17/10/2023.
The issue raised in the petition is non compliance of Solid Waste Management Rules 2016 and dumping of the garbage, solid waste all around the main road or the road of the colonies or the vacant plot in the area Chandbad, Simra Gate and Purshottam Nagar situated within the jurisdiction of Municipal Corporation, Bhopal.
The newspaper article published in 'Dainik Bhaskar Daily', October 16, 2023 revealed the various illegalities and non compliance of the environmental rules, dumping of the wastage in violation of Solid Waste Management Rules and disposing it by way of burning in the open land at gate no. 4 of All India Institute of Medical Science. The activities are in violation of environmental rules causing health hazardous and air pollution that too within the vicinity of a hospital.
The tribunal directed notice to be issued to the state of Madhya Pradesh through Collector Bhopal; Municipal Commissioner, Bhopal; Central Pollution Control Board and Madhya Pradesh Pollution Control Board. The respondents have been directed to submit their reply within six weeks. In addition, a three member committee has been asked to visit the place, examine the facts, take remedial measures and submit the factual and action taken report within four weeks.
