Order of the National Green Tribunal in the matter of Shamsher Singh Vs Govt. of NCT of Delhi dated 17/10/2023.

The matter related to dumping of sewage by unauthorized trucks/vehicles on roads and drains resulting in pollution and damage to environment.

The tribunal by its order, December 21, 2022 had taken note of the recommendation of the joint committee report, December 18, 2022 and directed the Chief Secretary to take up follow up action in coordination with the concerned departments/authorities.

The court in that order had also taken note of the serious issue relating to septage management in the localities without sewer system. Certain directions were issued to the Delhi Jal Board (DJB) in respect of identification and notification of the localities not having sewerage so that proper septage disposal practice could be enforced there.

Considering the seriousness of the issue involved, the Tribunal had required the Chief Secretary, Delhi to file action taken report. However, no report has been filed by the Chief Secretary, Delhi.

A compliance report, May 9, 2023 by the Delhi Pollution Control Committee (DPCC) has been filed but the report also does not reflect any effective steps taken at the ground level to improve the situation.

The NGT, October 17, 2023 considering the issue involved, has given six weeks time to the Chief Secretary, Delhi to file the action taken report in terms of the order of the tribunal, December 21, 2022.
