Order of the National Green Tribunal regarding the state of waterbodies in Gurugram, Haryana, 03/08/2023
Order of the National Green Tribunal in the matter of Virendra Tyagi Vs State of Haryana dated 03/08/2023.
The applicant has sought the court's intervention for the protection, cleaning and preservation of aquatic life of the water body for the health and hygiene of the e neighborhood community in Sector 47, Gurugram, Haryana. The applicant has submitted that there is a water body with an area of about 3 acres approximately in Sector 47, Gurugram. The water body has not been protected and cleaned. The same is now being used as a waste dumping ground, has been encroached upon by setting up Jhuggies and is also being unauthorizedly used as grazing ground. Due to waste dumping, the pond has become a breeding place of mosquitoes and other insects resulting in unhygienic and unsanitary environmental hazards.
The NGT, August 4, 2023 taking into consideration the averments made in the application, directed a joint committee to be constituted to verify the factual position and take appropriate remedial action. The committee comprising of the Haryana State Pollution Control Board (HSPCB) and District Magistrate (DM), Gurugram was ordered by the court to visit the site, verify the factual position and take appropriate remedial action by following due course of law.
The committee was also asked to report the status of water bodies as per the revenue record and also status of compliance with regard to other waterbodies in district Gurugram. A factual and action taken report has to be submitted within two months.
