Judgment of the National Green Tribunal in the matter of Gautam Sharma Vs State of Uttar Pradesh & Others dated 17/07/2023.
Gautam Sharma, resident of village Haji Mohammadpur Kotkadar, tehsil Nagina, district Bijnor, Uttar Pradesh through his letter petition complained that illegal mining of sand and murram was being done in the area of river Khoh.
The court noted that from the report filed by the Uttar Pradesh Pollution Control Board (UPPCB) it becomes clear that the SPCB has not taken any action for imposition of environmental compensation on the mining permit holders for not obtaining consent to establish and consent to operate from the UPPCB.
The NGT directed the UPPCB to take appropriate environmental compensation on the mining permit holders on realization of EC. The amount should be utilized for remediation of environmental damage caused by breach of the terms and conditions thereof by implementing environmental amelioration measures in the area like plantation programme through DFO, Bijnor, the order said.
