Order of the National Green Tribunal in the matter of Association of Fly Ash Products Manufacturers (AFAPM) Vs Ministry of Environment, Forest & Climate Change & Others dated 13/07/2023.
The applicant had challenged Notification dated December 31, 2021 and Notification dated December 30, 2022 issued by the MoEF&CC on the ground that it is in contravention of Hazardous Waste (Management, Handling and Transboundary Movement) Rules, 2016 so far as it relates to utilization, transportation and disposal of fly ash in an environmentally sustainable manner and in violation of order of the Supreme Court, May 10, 2022 (Civil Appeal No. 2947 of 2020, M/s. Aravali Power Co. Pvt. Ltd. vs. Vedprakash and Anr). The applicant also challenged the advisory dated February 22, 2022 issued by the Ministry of Power on the ground that it was in contravention of environmental rules.
The NGT directed the Secretary, Environment and Secretary, Power to submit a joint report with regard to the contentions raised in the application with a viable solution so that 100 per cent utilization of fly ash can be ensured.
