Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Saikhowa Sadiya Min Samabai Samity Limited Vs Union of India & Others.

The matter related to discharge of effluents by M/s Brahmaputra Cracker and Polymer Limited (BCPL).

The Original Application was filed by Saikhowa Sadiya Min Samabai Samiti Limited seeking a direction  to ban the release of toxic effluents into the Brahmaputra Part-III, IV and V Fishery by the Brahmaputra Cracker and Polymer Limited (BCPL) and to shift the release point of the effluents through underground pipe carried out by the BCPL downstream the river Brahmaputra beyond the boundary of the Brahmaputra Part-III, IV and V Fishery.

A compliance affidavit, September 4, 2021 was filed by the Assam Pollution Control Board - wherein a fresh analysis report of treated effluents of Brahmaputra Cracker and Polymer Limited, (BCPL) unit at final discharge point of Brahmaputra river and water sample collected from Sessa river downstream of M/s BCPL, Lepetkata was collected on August 18, 2021. The analysis report showed that all the parameters taken from water from Sessa river downstream of M/s BCPL, Lepetkata, are well within the permissible limits.
