Order of the National Green Tribunal in the matter of Sunil Kumar Sharma Vs Uttar Pradesh Industrial Development Authority & Others dated 27/08/2021.
A report was sought from District Magistrate, Ghaziabad with reference to the allegation that there was encroachment on the green belt, in violation of the Master Plan, by way of a private building named ‘Udyog Bhawan’ at Ghaziabad.
The report of the District Magistrate, Ghaziabad, September 11, 2020 acknowledged the encroachment and the NGT, September 25, 2020 directed remedial action to be taken and filing of compliance report.
The NGT, August 27, 2021 noted that no compliance report has been filed as directed by the court and directed the District Magistrate, Ghaziabad to assess and recover compensation for wrongful encroachment of public land in the green belt. Pending assessment of final compensation, a token amount of Rs. 10 lakh be deposited as interim compensation for the violations by the Industrial Area Manufacturers Association.
