Order of the National Green Tribunal in the matter of Poonam Yadav Vs M.C. Farrukhnagar & Others dated 07/04/2021. Grievance in this application is against setting up of a landfill site on grazing land, without any Environmental Clearance (EC), at Farrukhnagar, district Gurugram, Haryana, in violation of the siting criteria.

Two reports were filed - one by the Haryana State Pollution Control Board on April 1, 2021 and the other by the Municipal Council, Farrukhnagar on April 5, 2021. The court was informed that show cause notice was given by the state PCB to the Municipal Council on March 30, 2021 for the violations and the Municipal Council had proposed to take remedial measures. It was proposed to set up MRF facility by May 15, 2021, start work of source of segregation and remediation of legacy waste from May 30, 2021.

The NGT directed the Chief Secretary, Haryana to review the ground situation and take remedial action in terms of the previous orders of the court passed in related matters - including taking of appropriate coercive action against erring officers and recovering compensation, for upholding the rule of law and protection of environment and public health. The time lines in the action plan proposed must be accordingly preponed and further action appropriately expedited. Grievance that waste management is proposed on grazing land must also be looked into, the order ordered.
