Order of the National Green Tribunal regarding management of construction and demolition waste in Delhi, 02/11/2020

Order of the National Green Tribunal in the matter of Pawan Kumar Sharma Vs Govt. of NCT of Delhi dated 02/11/2020.

The issue for consideration is the remedial action for compliance of Construction and Demolition Waste Management Rules, 2016 by the IL&FS Company at Jahangirpuri, Delhi.

The DPCC in its report of January 24, 2020 said that the off take target of total 16.07 lakh metric tons was fixed by the Ministry of Housing & Urban Affairs (MoHUA) for various agencies for off take of construction and demolition waste recycled in the financial year 2019-2020. The North Delhi Municipal Corporation (North DMC) was asked to take necessary action to get rid of the huge deposition of C&D waste in front of main boundary wall of the Construction and Demolition Waste Processing Facility at Jahangirpuri. The NHAI , NBCC, CPWD, DDA, DMRC, PWD, DSIIDC, I&FCD, NDMC, East DMC, South DMC , North DMC , DUSIB, DTTDC, NDPL and BSES and other departments and Organizations in NCT of Delhi (which are involved in construction and maintenance of civil works) was asked to expedite and maximize the utilization of C&D waste recycled materials and products of the 3 C&D waste processing facilities in Delhi at Jahangirpuri (Burari), Shastri Park and Mundka (Rani Khera) in their projects to meet the targets fixed by MoHUA.

Another report filed by the DPCC mentioned the progress made by various departments in lifting C&D recycled materials from the 3 existing C&D waste processing facilities of IL&FS at Jahangirpuri (Burari), Shastri Park and Mundka (Rani Khera). All the government departments and agencies has been asked to make efforts and necessary plans to enhance the lifting/off-take of C&D recycled materials to meet the targets set for them, the DPCC said.

Approximately 3900 TPD of construction and demolition waste (C&D waste) is generated in Delhi which requires dedicated handling mechanism and disposal thereof. Accordingly, separate collection and transport infrastructure of C&D waste has been set up under which the C&D waste is collected at ear marked sites identified by the 3 municipal corporations (North DMC, EDMC and SDMC), New Delhi Municipal Council (NDMC) and Delhi Cantonment Board (DCB) and the same is transported to the construction and demolition waste processing and recycling facilities in Delhi.

After commissioning of one new C&D waste processing facility at Bakkarwala (in South DMC area) and expansion of the capacity of the C&D processing facility at Shastri Park from 500 TPD to 1000 TPD, now there are 4 operational C&D waste processing and recycling plants in Delhi with a total capacity of 4150 TPD.

In these processing facilities, paver blocks, kerb stones, bricks, aggregates, sand and soil of BIS standards are being produced out of the C&D waste which are further used in the infrastructure projects, thus fresh requirement of natural resources is minimized. With the existing and proposed processing facilities, it is expected that the entire C&D waste generated in Delhi will be managed properly in a scientific manner, according to the report by the DPCC.

The NGT noted that off-take by the concerned departments has yet to increase and the same needs to be further monitored. Percentage of target achieved is said to be 74.01%, 41.1% and 43.1% by DDA, DMCR and EDMC respectively which means that the target set by the MoHUA has not been fully achieved.

In view of the above, the NGT directed further monitoring be done and the status reviewed by the Chief Secretary, Delhi on a periodical basis.
