Order of the National Green Tribunal regarding illegal activities of marriage halls, Ghaziabad, Uttar Pradesh, 18/10/2019
Order of the National Green Tribunal in the matter of Sri Om Tyagi Vs Ministry of Environment & Forest & Others dated 18/10/2019 regarding remedial action against illegal activities of marriage halls in question at Ghaziabad being run without requisite consent and compliance of environmental norms.
Report filed by a joint committee comprising of Central Pollution Control Board (CPCB), Uttar Pradesh Pollution Control Board (UPPCB) and the Divisional Commissioner, Meerut mentioned violations of Solid Waste Management Rules, illegal extraction of ground water and absence of requisite permissions under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. And the action taken by the authorities was to seal the borewells, passing of closure orders followed by disconnection of electricity.
The Tribunal had directed assessment and recovery of compensation for damage to the environment and further preventive and remedial action. Further report filed by the UPPCB has stated that compensation has been assessed and would be recovered.
The court has ordered the concerned authorities to prepare a plan to ensure that such "large scale violations" are not repeated and for that continuous vigilance should be maintained in the area.
