Order of the National Green Tribunal regarding closure of M/s Lubok Carbon LLP under Air Act 1981, 11/04/2019
Order of the National Green Tribunal in the matter of M/s Lubok Carbon LLP Vs Rajasthan State Pollution Control Board & Others dated 11/04/2019 regarding closure of M/s Lubok Carbon LLP under Section 33(A) of Water (Prevention and Control of Pollution) Act, 1974 and Section 31(A) of Air (Prevention and Control of Pollution) Act, 1981.
The unit is located at Village Karwas, Tehsil Kotputli, District Jaipur. It was with the view to establish an industrial unit, that Lubok Carbon had applied for conversion of the agricultural lands to industrial use but the the villagers of Village Karwas and Sarpanch, Jaisinghpura as well as one Radhey Shyam filed a complaint before the SDO, Kotputli, stating inter-alia, that conversion of the land in question was granted for the purpose of establishing an industry which was nonpolluting. After considering the fact that the unit was with regard to tyre pyrolysis which was considered to be a polluting industry, the SDO set aside the order by which the conversion was initially granted.
The NGT is also of the view that the industry falls under the red category and thus cannot operate as of now. Tribunal directs the industry to get the issue of conversion and then take approval from the Rajasthan State Pollution Control Board to operate, as per law and in accordance to the guidelines issued by the Rajasthan State Pollution Control Board.
