Order of the National Green Tribunal in the matter of Noorul Sehar Lari Vs State of Uttar Pradesh & Others dated 10/10/2022.

Grievance in the application is against discharge of untreated sewage at Lar, district Deoria, Uttar Pradesh on open land (khasra no. 1712) with an area of 0.1980 hectares.

Report filed by the Principal Secretary, Urban Development informed the court that a comprehensive city sanitation action plan (CSAP) of the Nagar Panchayat Lar amounting to Rs. 7.40 crore to be funded under Swachh Bharat Mission 2.0 has been prepared.

The NGT said that it is seen that though action plan involving funding of Rs. 7.40 crore has been prepared, the same has not been accepted. Violations are still continuing. "Only action reported is at the stage of proposal to collect sewage and take it to stabilization ponds as interim measure till establishment of STP facility," observed the court.

The NGT directed the state of Uttar Pradesh to deposit a sum of Rs. 7.5 crores in a ring-fenced account within one month with the District Magistrate, Deoria for preventing discharge of untreated sewage into the drains. The sewage must be treated suitably and used for secondary purposes such as irrigation.

The joint Committee headed by ACS/Principal Secretary, Urban Development, Uttar Pradesh with nominees of the Central Pollution Control Board (CPCB), Uttar Pradesh Pollution Control Board and District Magistrate Deoria as members may oversee utilisation of the amount for the purpose, the order said.
