Centre to press ahead with its curative petition in the SC for more compensation to Bhopal gas disaster victims, 11/10/2022

Order of the Supreme Court of India in the matter of Union of India & Others Vs M/s. Union Carbide Corporation & Others dated 11/10/2022.

Attorney General, R. Venkataramani informed the Supreme Court (SC) that the government of India would like to press forward with the curative petition against Union Carbide Corporation seeking additional compensation to the victims of Bhopal gas tragedy. A number of NGOs seek to be added as parties to the curative petition.

Union Carbide Corporation contented that the "very maintainability of the curative petitions will have to be examined as it came 19 years after the judgment was passed and without going through a process of review petition. The persons who filed the review petitions on which orders were passed have not filed curative petition".

The five judge bench of the Supreme Court directed that the government of India would represent the claim of the persons who suffered due to the Bhopal gas disaster and said that a joint compilation should be prepared by the office of the Attorney General and the government.

The joint compilation has to be prepared within 56 days and the SC listed the matter for January 10, 2023.

A Curative Petition is the last chance available to a party to ask the court to reconsider a case it is filed after the court refuses to review a judgment.

In December 2010, the Government of India had filed a curative petition praying for Rs 7400 crores in addition to the settlement amount already disbursed by Union Carbide saying that the settlement was seriously impaired and does not take into account the quantum of deaths, injuries, and losses.
