Factual and action taken report in the matter of Vimla Kol Vs State of Madhya Pradesh.

The matter related to sand mining, village Barach, Tehsil Jaysinghnagar, district Shahdol, Madhya Pradesh on the riverbed of Jhanpar river. The two mines have obtained NOC from Gramsabha Barachh. Environmental clearance has been issued by SEIAA on the basis of recommendations by the State Level Expert Appraisal Committee.

The villagers and officials of the Gram Panchayat, village Barach had filed the complaint before the NGT. It was alleged that no proposal was made by the Sarpanch, District Member and Deputy Sarpanch, Barach in relation to the sand mines. Further, the sand excavation of the Jhanpar river has had a huge impact on the water level.

The committee after inspection of the mining sites, June 7, 2022 in its report to the NGT said that the mining lease holder had got all necessary permission and valid approval from the concerned authorities. "It seems that the matter raised in complaint are based on possibilities and unfounded assumption and faulty notion," the report said. The present situation is that the mining activities in these mines have been stopped just after commencement in the month of January 2022 and could not be possible up to September 2022 due to monsoon season.
