Status report by way of affidavit on behalf of Department of Irrigation, Uttarakhand in Original Application No. 248 of 2021 in the matter of Vipin Nayyar Vs Union of India & Others.

The matter related to construction activities at the bank of river Ganga, where public toilets are being constructed by the Municipal Corporation, Rishikesh and the entire waste therefrom, is directly flown in river Ganga causing pollution. It was further stated by the applicant that no STP has been constructed and the entire untreated discharge is directly leaving to river Ganga.

The report by the Department of Irrigation, Uttarakhand stated that the construction work of the Chila Jal Vidyut project was started in the year 1974-75. In the year 2010, vide order No. 321/11-2009-03 (45) 2003, February 5, 2010, the government of Uttarakhand transferred the Cheela Jal Vidyut Project with maintenance and for its operation to the Uttarakhand Jal Vidyut Nigam Limited. The construction of the toilet in dispute is after the year 2018.
