Order of the National Green Tribunal in the matter of Khanan Grasth Sangharsh Samiti & Others Vs Union of India & Others dated 23/06/2021.

The matter related to violation of conditions of environment clearance (EC) granted for mining of minor minerals taking place around villages Shuklavas, Pichani, Pavana, Bhuchara and Dhudhawas, tehsil Katputli, district Jaipur, Rajasthan. Around 15 mines are carrying out unscientific and environmentally harmful mining around the villages.

The court in its previous order of August 28, 2020 had directed a committee to visit the site and submit a factual and action taken report.

The report submitted by the committee stated that mining was done upto the minimum depth of 125 ft and blasting has been taking place, affecting nearby buildings.

The NGT, June 23, 2021 directed the Director of Mines to regularly monitor the illegal sand mining in the area and take action to regulate and enforce the relevant guidelines issued in 2016 and 2020. The Collector has been directed to report the damage to the school building and other buildings due to blasting in addition to the distance from the human habitation. The Rajasthan State Pollution Control Board has been ordered to report the violations of environmental conditions and the damage caused.
