Order of the National Green Tribunal in the matter of Prabhat Mohan Pandey & Others Vs State of Madhya Pradesh & Others dated 09/03/2021.
Grievance in the application was against the unscientific sand mining in district Chhattarpur, Madhya Pradesh by Anandeshwar Agro Foods Pvt. Ltd.
The bench of Justice Adarsh Kumar Goel and Justice Sheo Kumar Singh noted that the issue of remedial action against illegal and unscientific sand mining has been dealt with by the NGT in its order of February 26, 2021.
The NGT in that order had directed all the states/UTs to follow the Sustainable Sand Management Guidelines (SSMG) 2016 read with Enforcement & Monitoring Guidelines for Sand Mining (EMGSM) 2020 reinforced by mechanism for preparation of district survey report (DSR), environment management plans, replenishment studies, mine closure plans, grant of EC, assessment and recovery of compensation, seizure and release of vehicles involved in illegal mining, other safeguards against violations, grievance redressal, accountability of the designated officers and periodical review at higher levels.
In view of the NGT order of February 26, 2021 - the court directed that the copy of the order along with the application be forwarded to the Secretary, Environment, Madhya Pradesh for being dealt with in accordance with the NGT order of February 2021.
