Order of the National Green Tribunal in the matter of Centre for Environment Protection Vs State of West Bengal & Others dated 09/12/2019 regarding Chalfilh Tourist Destination Project, Phase I & II, Mizoram.

The applicant had said that the project was in violation of Forest Act, 1980 and Environment Impact Assessment (EIA) Notification, 2006. The affidavit filed by Mizoram has conceded to the environmental violations alleged in the application.

The Tribunal noted that Phase-1 of the project had been taken up and completed without obtaining necessary clearance under the Forest (Conservation) Act, 1980, and environmental clearance under the EIA Notification, 2006. Further, the project falls within reserve forest area.

The Ministry of Environment, Forest and Climate Change has been directed to take up the matter and "initiate appropriate proceedings under Sections 3 A and 3 B of the Act read with Rule 9 of the Forest (Conservation) Rules, 2003," the NGT order read.
