Order of the National Green Tribunal in the matter of Mahanoy River Safety Society Vs State of Bihar & Others dated 26/08/2019 regarding construction of an administrative building in Khasra no. 118 falling within the prohibited area of Mahanoy river.

The Bihar Building Bye-Laws 2014 [Rule 22 92)] states that "in case of rivers other than the Ganges, no construction or reconstruction of any building shall be allowed, within a strip of land of 100 metres, or such distances as prescribed by the State Government, from the outer boundary of the riverfront of any river." Thus, it becomes clear that the construction falls within the prohibited area of the 100 meters as prescribed in the above provision. The government counsel has sought for time from the Tribunal, which has been allowed.
