Order of the National Green Tribunal in the matter of Sarang Yadwadkar & Others Vs State Govt. of Maharashtra & Others dated 27/08/2018 regarding dumping of debris on the bank of river Mula - Mutha within the limits of Municipal Corporation, Pune.

This Application seeks execution of Order dated 16.03.2016. The Court had directed that 14% of the cross-section area which are falling within the flood plain/blue line would be identified by the authorities concerned and debris would be removed and other material of construction in that area and bring it within the ambit of the blue line. Pune Municipal Corporation has expressed difficulty in the removal of all debris and the construction as it will involve huge cost. NGT accepts the solution put forward by the Applicant which states that the Irrigation Department is the custodian of the river bed and if Respondent No. 1 has failed to carry out the orders, the Irrigation Department itself should carry out the said work at the cost of Respondent No. 1.
