Order of the National Green Tribunal in the matter of Shiv Prasad Vs Union of India & Others dated 03/08/2018. The question raised in this Application is whether the industry in question Josodhapur Industrial Area, Kotdwar, Pauri Garhwal requires environmental clearance and whether such clearance has been given. Further question is whether they are creating pollution without taking requisite precautions by way of installing pollution control equipments and also question about the solid waste disposal.
NGT directs the Central Pollution Control Board and the State Pollution Control Board to inspect each of the units within one week to ascertain whether they are operating with valid consents and clearances. If they are found to be operating illegally without obtaining consent to operate and requisite clearances or if they are emitting pollutants in violation of the standards prescribed, the State Pollution Control Board shall take appropriate action in accordance with law.
